Kemsley filed for bankruptcy in March 2012, stating $34k in monthly costs and personal debts ranging from $10M to $50M, with creditors including Spreadex, HMRC, HBOS, and Joe Lewis. However, Barclays Bank is still suing him in the United States for a £5 million loan. The United States Bankruptcy Court first ruled against the trustee who had filed for chapter 15 bankruptcy in March 2013. Judge Peck refused Kemsley’s application, describing him as a “bankrupt who doesn’t live like one.” However, Peck denied Barclay’s claim two months later in state court, claiming that Barclays had essentially mousetrapped themselves by extending the loan to Kemsley.
