On 1 June 2019, Fotis Dulos and Michelle Troconis were detained and charged with manipulating the evidence and obstructing prosecution in a hotel in Avon, Connecticut. There was insufficient evidence to justify further harsh charges at the time. The five children from Dulos, aged 8 to 13, moved to New York City, where the judge granted temporary custody, living with Jennifer’s moather, Gloria Farber. In order to represent him, Fotis Dulos hired Attorney Norm Pattis. In an interview, Pattis seemed to be satisfied that Jennifer had been killed before he was hired by Fotis. Both Dulos and Troconis argued against the charges not guilty.
Both Dulos and Troconis were arrested again in September 2019 because of evidence tampering. Both of them argued not guilty. After being accused of spousal rape, Mawhinney was alienated from his wife. His wife walked to the police in South Windsor and told the authorities that she feared Fotis and Mawhinney would collaborate in killing her. After Jennifer had gone, a shallow gravesite was found, filled with 2 lime bags and a blue tarp, in a secluded estate that Mawhinney had owned. In August 2019 authorities and K9 dogs found the grave but the grave did not contain a body and it was found that the objects had been removed.
After the arrests, the family of Jennifer issued a declaration. Dulos was issued a $6 million bond on January 8. The following day he was released and due on 28 February 2020. He was released from prison. Michelle Troconis stated in a statement published in May 2020 that it was ‘mistake’ to trust Dulos. She still claimed she didn’t know what happened to Jennifer or her place.Troconis had to go to court on 6 August 2020 to face charges, after being released on bail. Mawhinney is held in place of a bond of $2 million and will appear before court on 3 September 2020 .

During her arrest, Dulos was not appearing for an emergency bond hearing in Stamford Court House on 28 January 2020. He was found in the reactionary state of Farmington, Connecticut by police at its $5 million home, after deliberately poisoning himself with carbon monoxide by carrying a vacuum-cleaner hose from his SUV’s exhaust system to the inside of the car while it was being stored in the garage. Some news agencies reported that Dulos was found dead, but that CPR was performed by respondents and a weak pulse was restored.
He was taken to the medical center UConn in Farmington, Connecticut by ambulance, and from there he was taken to the medical center of Jacobi, in the Bronx area of New York, for hyprenatal oxygen treatment. Before life support was taken away, his five children visited him in the medical center. They saw their father for the first time since he was accused of murdering his mother.
At the Jacobi Medical Center, on 30 January 2020, Dulos was pronounced dead. He was fifty-two years old. In his car, he left a suicide note saying, “I refuse to spend even an hour more in jail for something I had NOTHING to do with” The police report states that the morning of the suicide at home was Dulos’ new girlfriend, Anna Curry. They planned to drive together to the court hall, but Dulos said they should drive individually. On the way to the courthouse Curry was asked by Dulos’ lawyer where his customer was. The lawyer told Dulos that the GPS tracker showed that he was still in his home and Curry said she knew that Fotis had to do anything to harm herself and asked her lawyer to call 911.
