Foster claimed in court that the tweet was sent at a time when some anonymous Twitter accounts claimed she was having an affair with one of her security guards. After Jessen lost the case in May 2021, Mr. Justice McAlinden awarded Foster £125,000 in damages and full costs, describing Jessen’s actions as “an outrageously bad libel.” The judge also said that Jessen’s failure to retract or apologize for the libel was an aggravating factor.
