Phillips was the son of Marine KC-130 crew leader Gerald Amon Upchurch and Lucita Umayam Aranas at the Subic Bay Naval Station in the Philippines. His father was an American, descended from Cherokee and Scots-Irish. Leland “Lou” Diamond, a US Marine, is the reason behind Phillips’ name. His stepfather adopted him after his father passed away, and he assumed the Phillips surname. He earned his diplomas in drama from the University of Texas at Arlington and Flour Bluff High School in Corpus Christi in 1980.

Phillips  got to know assistant director Julie Cypher while filming Trespasses. On September 17, 1987, they tied the knot; on August 5, 1990, they got divorced. Cypher came out as a lesbian and started a committed relationship with Melissa Etheridge following their divorce. Phillips guest-starred on Law & Order: Special Victims Unit in the episode “Fault” as Victor Paul Gitano, a rapist, kidnapper, and spree killer, and a registered sex offender. Malcolm is high, so they follow him to a drug dealer’s murder and encounter Saulo and Dani. The mother’s boyfriend is accused of being the one who stabbed the corpse more than a hundred times. It is found that Dani is attempting to hide her son’s crime when she is arrested on murderous accusations.

On August 11, 2006, Phillips was taken into custody for violating the peace at his Los Angeles residence after hearing loud noises coming from the residence he shared with Yvonne Boismier, his future wife and live-in girlfriend. After entering a not guilty plea to a misdemeanor charge of disturbing the peace in December 2006, he was given a three-year probationary period.

On November 3, 2017, while inebriated, Phillips pulled over to ask a police officer for directions in Portland, Texas, and was subsequently taken into custody. He was accused of driving recklessly. Phillips posted bail and was sent free. After reaching a plea agreement, Phillips received a two-year probationary sentence in April 2018.
